CITY OF AUSTELL - .099 BREATH TEST - STRIKING FIXED OBJECT
State v. K.S.
Defendant was stopped by Austell Police for striking fixed object. After performing field sobriety evaluations, defendant was taken into custody and read implied consent warning. During an inventory search of the vehicle, the officer discovered a bottle of open Sky Vodka. Defendant blew a .099 on the Intoxilyzer 5000. City of Austell Municipal Court dismissed the DUI in exchange for a guilty plea to reckless driving.

GWINNETT COUNTY - .082 BREATH TEST - FAILURE TO MAINTAIN LANE
State v. M.R.
Defendant was stopped by Gwinnett County Police for failure to maintain lane and following too close. Defendant failed all
field sobriety evaluations and was arrested and read implied consent warning. Defendant blew a .082 and .089 on the
Intoxilyzer 5000. After the motion to suppress hearing and right before trial, the State offered to dismiss the DUI in
exchange for a no contest plea to reckless driving.
GWINNETT COUNTY - .118 BREATH TEST - SPEEDING 54/35
State v. R.S.
Defendant stopped by Snellville Police for driving 54/35. After performing field sobriety evaluations, defendant was
taken into custody and blew a .118 on the Intoxilyzer 5000. The defendant retained a field sobriety and Intoxilyzer 5000
expert witness. After the jury heard from the defense expert, they found the officer not to be credible on how he conducted the field sobriety evaluations and found the
Intoxilyzer 5000 to have internal errors. Jury returned not guilty verdict on DUI and Speeding.

Defendant was stopped by Cobb Police for failure to maintain lane. Defendant failed all field sobriety evaluations and was taken into custody and read implied consent warning. Defendant agreed to breathe test and blew a .084. After motion to suppress hearing, the DUI was dismissed and defendant entered a no contest plea to reckless driving.
